It is a requirement that you get consent from your patients before using a tool that will capture their data.
Currently there is no legal requirement for signed consent - so verbal consent is sufficient. Consent must be noted in the medical record.
To ensure transparency and compliance, follow these steps:
- Get verbal consent for recording before each consultation starts.
- The first time you use a new recording tool with your patient, offer them the Patient Explainer and Patient Informed Consent form - patients have the right to know what could happen with their personal information.
- Note that consent has been obtained (every time) and the explainer and consent form was distributed (the first time you use the software with the patient). The patient explainer and consent form can also be distributed to the patient prior to the appointment as part of your practice's booking and onboarding workflow.
- If you/your practice would prefer to have consent in writing, you can use the patient informed consent form to collect signatures.
